PAYMENT AUTHORIZATION TERMS AND CONDITIONS

PLEASE READ THESE PAYMENT AUTHORIZATION TERMS & CONDITIONS CAREFULLY BEFORE COMPLETING A PURCHASE.

By submitting payment information or accessing any Services provided by the Company, you agree to be bound by these Payment Authorization Terms & Conditions. If you do not agree, please do not proceed with any purchase.

 

1.                  Defined Terms

All defined terms used in this agreement have the meanings provided in our Terms of Use under “Definitions”.

 

2.                  Overview of Services

The Company provides digital Services including access to a private online Community for parents and legal guardians, online educational courses intended to benefit them and their children, and related digital content as described on our Site, which may be updated or modified from time to time.

2.1.            Service Access

Access to these Services is granted only upon successful payment or during an approved trial period. Continued access to Services is personal, non-transferable, and contingent upon compliance with these Terms.

2.2.            Service Modifications

We may modify, update, enhance, or discontinue any aspect of the Services at any time. Such changes will not materially reduce the overall value or functionality of the Services provided to you. Your continued use of the Services constitutes acceptance of any modifications. You acknowledge that the nature of digital services evolves and that no specific feature, course, or Community element is guaranteed to remain available for the duration of your membership.

 

3.                  Disclaimer of Warranties

The Site and all Content is provided “as is” without warranties of any kind, express or implied. As such, the Company does NOT warrant or make any representations regarding the following:

·       That you will experience any transformation from using Services provided by the Company

·       The suitability of any Services provided by the Company for any User’s needs or the likelihood that their use will meet any User’s expectations

·       The accuracy, correctness, or reliability of any Services provided by the Company.

You accept all responsibility for evaluating your own progress as well as executing action required for potential transformation to occur. The degree of potential transformation you may achieve is entirely dependent on your own ability, efforts, availability, circumstances, and the amount of time you dedicate to implementing the Services as provided by the Company. The mental, social, emotional, and physical capacities of those involved will also greatly impact your rate of achievement or lack thereof with regard to the programs, materials, ideas, and techniques offered and provided by the Company.

 

Given that these factors differ greatly among individuals, the Company cannot and does not warrant or make any representations or guarantees regarding your success or the length of time or amount of effort that may be required to achieve desired results.

Please note that the applicable jurisdiction may not allow the exclusion of implied warranties. Some of the above exclusions may thus not apply to you.

 

4.                  Eligibility & Age Requirements

See also the section entitled “Children under thirteen (13) years old on our Privacy Policy page for related information.

Payment for and primary access to our Services is intended only for parents and legal guardians who are at least eighteen (18) years of age. While our Services are designed for use by adults with their children, minors may only access our Services under the direct supervision of a parent or legal guardian.

By creating an Account or making a purchase, you represent and warrant that you are not a minor and that you have the legal capacity to enter into binding agreements.

We do not knowingly permit minors to purchase or directly access our Services without adult supervision. If we discover that a minor has created an Account or made a purchase, we will revoke access, refund any payments made, and delete their Account.

We rely on User representations regarding age and do not collect government identification or date of birth for verification.

 

5.                  Plans & Pricing

We offer the following plan options:

·       Monthly Subscription Plan (recurring payments)

·       Annual/Yearly Subscription Plan (recurring payments)

·       Lifetime Membership Plan (one‑time payment)

“Lifetime Membership” refers to access for the lifetime of the Company and its operation of the Services. It does not refer to the lifetime of the purchaser. If the Company ceases to operate, discontinues the Services, or undergoes a business transition that results in the discontinuation of the Services, Lifetime Membership benefits will end.

Plans may include a free trial period available only to qualifying customers who meet criteria that is subject to change at the discretion of the Company.

5.1.            Rate Lock

Active plans for existing customers remain locked in at their original rate (the recurring price of the plan from when you initially enrolled) as long as payments continue without interruption.

Prices available for new and returning customers may vary due to promotions or sales and may increase over time to account for inflation or business adjustments.

5.2.            Fees

We do not charge any additional fees beyond the listed prices.

5.3.            Pricing Errors

While we strive for accuracy, pricing errors may occur due to human or technical issues. If a price is incorrect:

·       We may cancel or refund any payment made at the incorrect price.

·       We are not obligated to honor prices listed in error.

 

6.                  Payment Authorization

By submitting your payment information, you authorize the Company and our payment processors (including PayPal, PayPal Pay Later, Venmo, Stripe, Affirm, Cash App Pay, Afterpay, Crypto, Klarna, or Amazon Pay) to:

·       Charge your selected payment method for the partial or full amount of your purchase

·       Automatically process recurring subscription or one-time payments according to your chosen plan, including payments that begin at the end of a free trial period

·       Store your payment information securely as necessary to complete and satisfy its rights and obligations with regard to transactions, billing arrangements, and/or as otherwise authorized by you

·       Attempt to re‑process failed payments – up to three (3) times within a reasonable timeframe.

We will send an email notification to the email address associated with your Account for each failed attempt to process your payment.

All payment processing is handled by third‑party processors (such as PayPal or Stripe) that maintain PCI DSS compliance; the Company does not store or process raw payment card data.

You agree that you are responsible for ensuring your payment information is accurate and up to date, and that the associated account has sufficient funds to cover the amount of any payment(s) to the Company.

 

7.                  Free Trials & Automatic Renewal (California ARL Compliant)

If you enroll in a plan that includes a free trial:

·       The trial lasts up to ninety (90) days, unless otherwise stated.

·       You will receive clear disclosure of the price and billing frequency before the trial begins, including the length of the trial, the exact amount to be charged, and the billing frequency. This information is available at checkout. The first payment occurs immediately upon the expiration of the free trial.

·       Additional notification(s) will be sent to the email address on file regarding the date(s) on which future payment(s) will occur.

·       At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

·       You authorize the payment processor initially used and the Company to automatically charge your payment method at the end of the trial.

We will send a reminder email before the trial converts, as required by California law.

8.                  Refund Policy

Refunds are available within thirty (30) days of your initial payment for plans without a free trial period.

Refunds are NOT available for:

·       Plans that include a free trial period

·       Subscription renewals

·       Recurring payments

·       Payments made after the initial payment & before cancellation

8.1.            Requests for Refund

Refund requests must be submitted to [email protected] and require acknowledgement and approval before processing.

8.2.            Refund Policy Exceptions

Refunds may be issued as exceptions to our policy at the sole discretion of the Company. Exceptions that may warrant a refund include, but are not limited to, duplicate payments, technical errors, or unauthorized transactions.

We reserve the right to deny refund requests that appear fraudulent, abusive, or inconsistent with legitimate customer activity.

Chargebacks may result in immediate Account termination.

8.3.            Refund Method

Refunds are issued in full and not prorated unless otherwise required by law, and are issued using the original payment method only.

Refunds will NOT be issued in the form of:

·       Gift cards

·       Promotional credits

·       Coupons

·       Alternative products or services

·       Any method requiring deviation from your original form of payment and/or our standard payment system

 

9.                  Cancellation

To cancel your membership:

·       Log in to your Parent Community Portal Account

·       Select your profile picture (top-right of your browser window)

·       Select “Manage Your Account”

·       Choose “Billing & Subscription” from the menu on the left of your browser window

·       Navigate to your subscription near the bottom of the page and select the vertical ellipsis under the column labeled “Action”

·       Select “Cancel”

Cancellation results in the immediate revocation of access to all Services.

If you are having trouble cancelling your membership, please submit a request to [email protected].

 

10.              Service Access Revocation

Access to Services may be revoked immediately upon determination of a qualifying event, including:

·       Account Deletion

·       Membership or Payment Cancellation

·       Failed payment after three (3) failed attempts to reprocess your payment

·       Violation of Community rules

·       Violation of any Company terms or policies

The Company reserves the right to revoke access to Services without warning or prior notice when advance notice could reasonably result in harm, misuse, or disruption to the Community or our Services.

 

When access is revoked, we will notify you using the email address associated with your Account.

 

10.1.              Community Rule Violations

Community rules can be found in the “About” tab, here.

 

Decisions regarding Account termination for Community rule violations are final and made at our sole discretion. We reserve the right to refuse future access of any Services to individuals whose membership was revoked for rule violations, and we do not offer an appeals process for reinstatement. Sufficient Account data will be retained to allow enforcement of this policy.

If access is revoked due to Community rule violations, no refunds will be issued for past payments, and all future payments will be canceled.

 

11.              Plan Reinstatement

If your access to Services is revoked due to reasons NOT related to a violation, and you later wish to reinstate your membership:

·       You must formally request reinstatement by emailing [email protected] or by enrolling in a new plan on our Site.

·       Reinstatement is not guaranteed and may require enrollment in a new plan at current pricing, which may differ from your previous rate.

·       We do not guarantee restoration or retention of prior Content, course progress, Account settings, or other personal data associated with your previous membership or Account.

·       If you are requesting restoration of an Account that you previously asked to be deleted, restoration is only possible if the request is made in time for the Company to reasonably attempt Account restoration within two (2) months of when we initiated the deletion process. After that period, the Account and all associated data are permanently unrecoverable.

 

12.              User Communication & Notices

When you register with the Company and/or this Site, you consent to receive notices, notifications, messages, alerts, updates, invoices, receipts, announcements, agreements, disclosures, reports, documents, communications concerning new or existing products or services, or other records or correspondence from the Company electronically via email.

With regard to the communications described, you are responsible for:

·       Keeping your email address updated with the Company

·       Periodically reviewing communications sent to you

·       Taking timely and appropriate action as needed in response

·       Checking your spam folder (which can occur if you have previously unsubscribed from email communications or accidentally marked our email messages as spam)

You may always opt out of receiving future mailings by clicking "Unsubscribe" near the bottom of any email communications you receive.

 

13.              Severability

If any provision of these Payment Authorization Terms & Conditions is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable without affecting the validity and enforceability of any remaining provisions.

 

14.              Updates

We may update these Payment Authorization Terms & Conditions at any time by posting the revised version on this page. Changes take effect immediately upon posting. Continued use of our Services constitutes acceptance of any revisions. Material changes may also be communicated to the email address associated with your Account.
